Objective To determine whether presenting delivery room management options as defaults influences decisions to resuscitate extremely premature infants. Materials and methods Adult volunteers recruited from the world wide web were randomised to receive either resuscitation or comfort care as the delivery room management default option for a hypothetical delivery of a 23-week gestation infant. Participants were required to check a box to opt out of the default. The primary outcome measure was the proportion of respondents electing resuscitation. Data were analysed (...) using χ2 tests and multivariate logistic regression. Results Participants who were told the delivery room management default option was resuscitation were more likely to opt for resuscitation (OR 6.54 95% CI 3.85 to 11.11, p<0.001). This effect persisted on multivariate regression analysis (OR 7.00, 95% CI 3.97 to 12.36, p<0.001). Female gender, being married or in a committed relationship, being highly religious, experiences with prematurity, and favouring sanctity of life were significantly associated with decisions to resuscitate. Discussion Presenting delivery room options for extremely premature infants as defaults exert a significant effect on decision makers. The information structure of the choice task may act as a subtle form of manipulation. Further, this effect may operate in ways that a decision maker is not aware of and this raises questions of patient autonomy. In a crisis, societal needs take precedence over a patient’s best interests. Triage guidelines, however, differ on whether limited resources should focus on maximizing lives or life-years. Choosing between these two approaches has implications for neonatology. Neonatal units have ventilators, some adaptable for adults. This raises the question of whether, in crisis conditions, guidelines for treating extremely premature babies should be altered to free-up ventilators. Some adults who need ventilators will have a survival rate higher than some extremely premature babies. (...) But surviving babies will likely live longer, maximizing life-years. Empiric evidence demonstrates that these babies can derive significant survival benefits from ventilation when compared to adults. When “triaging” or choosing between patients, justice demands fair guidelines. Premature babies do not deserve special consideration; they deserve equal consideration. Solidarity is crucial but must consider needs specific to patient populations and avoid biases against people with disabilities and extremely premature babies. (shrink)

Background: It is not known how neonatologists address the affective and cognitive loads on parents deciding whether to resuscitate infants born extremely preterm. This study explores expert neonatologists' views on these decision-making processes and their own roles in counseling parents. Methods: Semistructured interviews asked internationally recognized experts to share their perspectives on perinatal consultations. Their responses were subjected to thematic analysis. Results: Eighteen of 22 invited experts participated. Approximately equal numbers reported employing a physician-driven approach, a parent-driven approach, and a (...) combined approach during these consultations. Those who followed a physician-driven approach typically focused on conveying standard information about adverse outcomes. Those who followed a parent-driven approach typically focused on addressing parents' information requests, guiding their decision making, and providing affective support. Nearly all experts, in each group, endorsed addressing the child's quality of life, in terms of functionality, when discussing long-term outcomes. Although many believed that families adjusted to life with a disabled child, few discussed the topic during prenatal consultations. Most, in each group, reported trying to alleviate future “decisional regret” for parents whose premature infants subsequently became disabled. None spoke to parents about possible decisional regret after deciding to forgo resuscitation. Conclusions: Expert neonatologists are deeply concerned that parents understand the decision facing them. However, they differ on what information they offer and how they balance parents' need for cognitive and affective support. They expressed more concern about parents' decisional regret should their child survive resuscitation, but have severe disability, than about decisional regret after foregoing resuscitation. Kind representations, concepts like table, triangle, dog, and planet, underlie generic language. Here, we investigate the formal structure of kind representations—the structure that distinguishes kind representations from other types of representations. The present studies confirm that participants distinguish generic‐supporting properties of individuals (e.g., this watch is made of steel) and accidental properties (e.g., this watch is on the nightstand). Furthermore, work dating back to Aristotle establishes that only some generic‐supporting properties bear a principled connection to the kind, that is, are (...) true of an individual by virtue of its being a member of a specific kind (e.g., telling time for a watch). The present studies tested the hypothesis that principled connections are part of the formal structure of kind representations. Specifically, they tested whether they structure a newly learned kind representation. Experiment 1 found that introducing a property of a newly encountered novel kind in any one of four linguistic frames that provide evidence that a property has a principled connection to a kind (e.g., “It has fur because it is a blick”) led participants to infer a different conceptual consequence of principled connections (i.e., “There is something wrong with this blick, which does not have fur”) for which they had no direct evidence. Two introduction frames that provided no evidence for principled connections (e.g., “Almost all blicks have fur”) did not generate the same consequence. Experiment 2 found that all of the targeted properties were generic licensing, irrespective of the introduction frame. That the distinction between properties that bear principled connections to their kinds, and merely generic‐supporting properties structures novel kind representations, provides strong evidence that this distinction is part of the formal structure of kind representations. L’article présente et analyse deux représentations de l’agent économique : celle de l’ homo œconomicus chez John Stuart Mill (1806-1873) puis celle de l’ animal laborans, expression que l’on trouve chez Hannah Arendt (1906-1975). Chacun des deux auteurs se situe en opposition à une conception de Jeremy Bentham (1748-1832) qui identifie l’être humain à un agent économique, être rationnel, apte au calcul et au raisonnement logique pour son cas personnel mais qui n’est cependant pas un être raisonnable, c’est-à-dire susceptible de (...) vivre en harmonie avec les autres sans le couperet d’une législation qui borne sa liberté. Mill, en désaccord avec la conception du bonheur de Bentham, attribue à l’être économique des aspirations plus élevées, lesquelles seraient à même de se réaliser dans le futur, pourvu qu’une égalité politique authentique, notamment entre hommes et femmes, soit enfin établie. Arendt, née un siècle plus tard, s’inquiète, pour sa part, de la dégradation de l’image que l’être humain a de lui-même en s’identifiant à un animal laborans. Archétype de l’individu dont toutes les occupations se pensent sur le modèle d’une activité nécessaire à sa satisfaction personnelle, enfermé dans le privé de son corps, l’ animal laborans qui n’éprouve que des sensations, de la peine ou du plaisir, s’apparente tout à fait aux êtres insuffisants, non raisonnables, que Bentham avait en tête pour concevoir la législation comme un moyen de les faire vivre ensemble. Si l’on suit Arendt, il n’est pas exclu que la conception benthamienne de l’homme, contre laquelle Mill s’était élevé, puisse devenir la réalité de demain, autrement dit que le règne de l’ animal laborans, être esseulé, ayant perdu jusqu’au besoin de guider lui-même sa propre conduite à l’égard des autres puisse finir par s’imposer. How can philosophy exert its critical function in society and in education if any appeal to independent and even relatively ‘certain’ criteria seems problematic? The epistemological doubts that foundationalist models of justification encounter unavoidably seem to raise this question. In particular, the relativist implications that seem to result from rejecting such models seem to paralyse the critical potential of philosophy of education. In order to explore the possibilities of a conception of educational critique that avoids the pitfalls of foundationalism, I (...) analyse the epistemological dimensions of this much-feared relativism, illustrating this with some characteristic examples. Solving the problems raised will require an interpretation of critique that leaves our daily sense of critique intact, without literally adopting its—foundationalist—basic assumptions. After systematically developing such an alternative interpretation of critical usage, a non-relativist but still non-foundationalist and powerful conception of philosophical critique seems possible. Cette prise en charge peut se révéler suffisante pour surmonter des difficultés passagères ; elle pourra aussi, par le travail d’élaboration psychique qu’elle favorise, déboucher sur un travail thérapeutique à proprement parler auprès d’un thérapeute individuel, conjugal ou familial. The role of critique in the Anglophone analytical tradition of philosophy of education is outlined and some of its shortcomings are noted, particularly its apparent claim to methodological objectivity in arriving at what are clearly contestable positions about the normative basis of education. Many of these issues can be seen to have a long history within European, and especially German, philosophy of education. In the light of this the discussion moves on to a consideration of similarities and contrasts between the (...) Anglophone and German-inspired deployment of the concept of critical rationality in philosophy of education. The claims to objectivity of the Anglophone tradition are contrasted with a more self-conscious concern for social justice and improvement in other European traditions, which has been followed more recently by a greater scepticism concerning the potential of critique for delivering social justice and improvement in education. This has parallels with the growing Anglophone disillusion with ‘classical’ analytic philosophy of education. This in turn has resulted in a greater awareness of the limitations of critique: its ideological character, its rootedness in specific contexts, its own potential dogmatism and its ambiguities. In reaction to Doret De Ruyter's recent defence of the importance of ideals in education, I advocate cautiousness in three respects. First, I explain the importance of distinguishing ideals more sharply from goals by demonstrating the problems of considering ideals even approximately realisable. Second, I substantiate my doubts about their indispensability in human motivation, and question the desirability of encouraging the motivational use of ideals. Third, I question whether ideals could or should be ‘passed on’ in education, drawing attention to (...) their non-objective, personally created nature. (shrink)

The question of whether protective labor legislation is beneficial to female workers has triggered much debate among feminist scholars. Like proponents of laissez-faire, some feminist scholars and activists have argued that such legislation harms the economic interests of women by lowering their wages and diminishing their employment prospects on the free labor market. This article reexamines the arguments made by opponents of protective labor legislation in the light of the historical development of the welfare state in Britain and France. It (...) is shown that the case against gender-specific protective labor legislation does not hold on empirical grounds. A strong body of evidence shows that protective labor legislation historically brought increasing economic returns and expanded opportunities to women in both countries. This has important implications for contemporary debates about the relationship between protective labor legislation and gender discrimination in the European Community, the International Labor Organization, and developing countries. Electrophysiology deals with apparatus applied in a stimulus response situation. This technique is partly concerned with physical problems, partly with biological ones. The failure to appreciate differences in these problems leads to assumptions which require critical examination. Assumptions stating the constancy of objective stimuli, the meaning of inter and intra-individual variation, and the stability of the so-called “resting level” are examined.Some experiments are cited which reveal complications by the apperception of the patient and which have a significant influence on electrophysiological (...) data. The evocation of stress reactions by routine laboratory procedures is discussed and a suggestion is made of the way in which the validity of electro-physiological measurements may be improved.Dans la science de l'électro-physiologie on se sert des instruments pour mesurer des processus de réaction d'une objet stimulée.La méthodique dans cette science est dérivée partiellement de la science biologique et partiellement de la science physicale.Une des difficultées est d'apprécier justement des differences dans les problèmes de mesure dans les deux terraines scientifiques, ce que mène à des assumptions douteuses, qui a besoin d'une examination scrupuleuze.Des assumptions concernant la constance de stimulations objectives, la significance des variations inter- et intra-individuelles et la stabilité du niveau, dit „resting level”, sont examinés.Quelques experiments, révelant des complexités dans l'apperception des patients ayant une influence importante sur les données électro-physiologiques, sont cités.L'évocation des réactions de tension, par des procedures routinières en laboratoire sont discutés et une suggestion afin d'améliorer la validité des données de mesure électrophysiologique est donnée.In der Elektrophysiologie ist man beschäftigt mit Instrumentarium, waraus die Zusammenhang zwischen Reiz und Reaktion untersucht wird. Es kommt vor, dass Unterschiede in Messungsprobleme innerhalb jedem Fachgebiet nicht richtig gewertet werden, was zu Annahmen führt, welche eine kritische Analyse bedürfen.Annahmen was betrifft, die Konstanz von objective Reize, die Bedeutung von inter- und intra-individuellen Variationen und die Konstanz des sogenannten „resting level”, wurden einer Analyse unterzogen.Einige Experimenten sind zitiert, die eine erhebliche Komplexität in der Wahrnehmungsempfindung des Patienten nachweisen und die eine bedeutungsvolle Einfluss haben auf den elektro-physiologischen Angaben. Das Hervorrufen Spannungsreaktionen durch Routine-vorgänge im Laboratorium wurde diskutiert und eine Weise um mit möglicherweise zuverlassigem Erfolg elektro-physiologischen Messungen aus zu führen wurde vorgeschlagen. Social license reflects environmental and social change, and sees community as an important stakeholder and partner. Science, scientists, and science policy have a key role in the processes that generate social license. In this paper, we focus on the interaction between science and social license in salmon aquaculture in south-eastern Tasmania. This research suggests that social license will be supported by distributed and credible knowledge co-production. Drawing on qualitative, interpretive social research we argue that targeted science, instilled by appropriate science (...) policy, can underpin social license by supporting emerging, distributed, and pluralistic knowledge production. Where social license is important and environmental contexts are complex, such knowledge production might support environmental governance, and so improve outcomes in coastal zone management and beyond. This article challenges the idea that success of boundary organizations is marked primarily by the stability of the science–policy interface. We review key theory in the literature on boundary work and boundary organizations. We then present a case, the Derwent Estuary Program in South East Tasmania, Australia, to explore the evolution of successful boundary organization. We detail how a science-oriented program of work achieved success, through early wins that cemented its support and created a relatively stable entity able to navigate (...) the expansion of its remit from managing controversy to implementing an integrated, systems approach to coastal zone management. The creation of “safe spaces” enabled contentious situations to be negotiated through well-established relationships and processes. The interaction among these elements, supported by exemplary leadership, was critical to reframing the problem. We suggest that it is through these abilities to navigate controversy and mediate among divergent interests, while maintaining a committed focus on science, that boundary organizations can succeed. Success in this context is achieved through using credible science to reframe problems. Success is further indicated not just by surviving periodic controversies but by being able to benefit from them, building legitimacy among partners and stakeholders through successfully navigating unforeseen events.
